On 2/8/17 the administrative law judge (ALJ) in PUCT Docket No. 45621, Notice of Violation by Current Utilities, Inc. of PURA § 39.353(A) and 16 TAC § 25.111(d)(1) Relating to Registration of Aggregators filed Order No. 8, Interim Order Granting Partial Summary Decision. It states, in part, “the ALJ concludes that the evidence indisputably establishes that Current served as an aggregator and provided aggregation services without first registering as an aggregator.” A hearing is still required, however, to determine if Current should be subjected to an administrative penalty, and if so, what is the amount of such penalty.
