FERC and NRC Have New Chairmen, Bay Resigns

On 1/26/17, Platts reported that FERC Chairman Norman Bay would resign on 2/3/17, after President Trump nominated Cheryl LaFleur as the new chair. “When Bay leaves in a week, FERC will be down to two sitting commissioners,” including Commissioner Colette Honorable, but three are needed for a quorum. “FERC will be unable to act on significant orders, rules and policy pronouncements, but some routine business could continue under authority delegated to office directors. ‘The commission will not shut down, but will be clearly hampered in what they can do going forward,’ said William Scherman, a partner with Gibson Dunn & Crutcher and a former FERC general counsel. ‘There’s a series of long-standing delegation orders where staff is granted authority to act under prescribed circumstances that will continue in effect,’ he added.” More also at RTO Insider

In other news, Platts reported that “US Nuclear Regulatory Commission Commissioner Kristine Svinicki has been appointed by President Donald Trump to be chairman of the US Nuclear Regulatory Commission, replacing the current chairman, Stephen Burns, an agency spokesman said Thursday. The appointment is effectively immediately, David Castelveter, director of NRC’s Office of Public Affairs, said. He did not provide further details.”
